1. You Will Be Detained, and Possibly Arrested…

If you’ve been forced into a self-defense incident the police will have to be involved. Tell the 911 dispatcher your location and describe yourself.

You will likely be placed in handcuffs. Though you will not necessarily be under arrest, you will be taken into police custody. Comply with the officers and don’t panic.

Remember, you have not done anything wrong. You were in fear for your life or the lives of others and were forced to employ deadly force in the defense of said innocent lives.

2. Your Gun Will Be Seized and Held as Evidence

It is likely that the police will be taking your firearm or defense weapon as “evidence.” This is a standard practice, and as long as you acted in self-defense and were in fear for the loss of innocent life you will be able to vindicate your actions with an attorney.

3. You Will Be Interrogated

After any self-defense incident you WILL be interrogated both at the scene of the shooting and at the police station.

Though it can be tempting to tell the officers everything that comes to mind — don’t! As a suspect the officers will be trying to get you to say as much as possible before you invoke your right to remain silent without an attorney present.

4. You Will Need an Attorney

If you don’t already have one you will need to hire an attorney, fast.

At this point you have one of three options: you can open a phone book and blindly choose a name, you can contact your personal lawyer or you can call the USCCA Critical Response Team to get the ball rolling on your defense.

5. You May Have to Post Bail or Pay Bond

Once arrested, you will likely be given the option to post bail. Posting bail can very difficult for the average individual, as self-defense incidents seem to happen after banker’s hours and few people keep thousands to hundreds of thousands of dollars in cash on hand.

Your options are to call a bail bonds company (if they are legal in your area), call a family member who may have the funds or contact the USCCA, who will handle the situation from there.

6. The DA Will Make a Charging Decision

After the self-defense incident the officers involved will gather their notes into a report and decide if they think there is evidence of a crime.

It can anywhere from days to weeks for all officers involved to complete their reports. The key here is to make sure you’re at home during this process, not sitting in a jail cell…

  1. It is scary to think that you can go from defendant to villain in a court of law, because you shot your attacker in self defense. His next blow or stab could have killed you and you didn’t have time to ponder alternative options. But isn’t this the situation cops can find themselves every day? Split second decisions for one, weeks and months for lawyers and investigators to look at every aspect of the case. 128

  2. Rest assured that your covered by USCCA, except in WASHINGTON STATE. I received a cordial phone call from a USCCA representative informing me that my membership would be terminated because of a standing Washington State law. I will not get into the details of the law but if you have questions or have not yet received this notification from USCCA; I would inquire immediately!
    USCCA apologized but will, however, continue my subscription to their magazine (which I enjoy tremendously.)
    I hope the liberal Democrats in this State would overturn this law but I don’t see that happening anytime soon.

  4. I used to be a member ,until I was informed that since I was a resident of New York state I would not be covered by their legal help. It seems as if you are a resident of N.Y. you are S.O.L

  5. I had no idea of. The legal ramifications of having a ccw. Who needs that threat of being locked up or worse being sued by the purps relative’s . It’s just not wise to carry at all if the odds are against you. I personally will not carry anymore. Many thanks for the heads up on this issue…. Ex CCW…

They support socialism. EVIL. They support communism. EVIL. They welcome atheists. EVIL. Make no mistake atheists aren’t saying I don’t believe they’re saying there is no one with absolute knowledge anywhere in the universe. Well without having that yourself you can’t say that! So that’s EVIL. They want to disarm people. EVIL. They protect pedophiles. EVIL. They don’t support the death penalty. So a baby rapist can live but an unborn baby can’t. Governor’s like VAs support infanticide. Keeping the baby comfortable HIS WORDS IT IS ON TAPE and then the mother and doctor will decide if they should kill it. EVIL. Democrats support harvesting organs from living fetuses. EVIL. They routinely lessen the punishment for crimes or even let criminals out of prisons hiding behind things like overcrowding. EVIL. So you lay down your weapon if you want, but I promise you that won’t make you any less safe. It just makes you potentially the next victim of EVIL.

  6. I’m a proud member of USCCA. Being a member, my wife and I can rest assured that if we ever do have the need to defend ourselves using deadly force,we are covered by USCCA! We pray that time will NEVER happen. But like auto insurance, homeowners insurance, and medical insurance, you carry those insurances JUST IN CASE!
    Also, their magazine is worth the membership. It’s a very high quality magazine covering ammo, methods of defense, excellent articles and reviews of all aspects of defensive weapons including non-lethal. We wouldn’t be without USCCA!
